The petitioner is languishing in custody since 30.05.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 323, 395, 376/511, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the petitioner and others entered into the house of the complainant robbed the household articles including cash and jewellery and petitioner attempted to establish forceful physical relationship with the informant. It is submitted by learned counsel for the petitioner that for the occurrence of 27.02.2013 the complaint was filed on 14.03.2013 which came to be registered as police case on
Patna High Court Cr.Misc. No.33491 of 2014 (03) dt.12-01-2015 2/2 19.08.2013 when the complainant-informant at earlier point of time on 03.03.2013 filed Gaya Muffasil P.S. Case No. 117 of 2013 against the petitioner making accusation under Sections 147, 341, 323, 427, 447, 504 and 379 of the Indian Penal Code but there no accusation was levelled about the present occurrence of 27.02.2013.
Considering the delayed lodging of the complaint and inconsistency between the two FIRs, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Muffasil P.S.
