Petitioner apprehends arrest in a case registered for the offence punishable under section 147, 148, 149, 307, 325, 379, 504 and 506 of the Indian Penal Code.

As per the prosecution case, the informant was standing at his door, in the meantime all the FIR named accused persons along with this petitioner armed with weapon assaulted the informant with rod causing head injury to him. It is submitted that both the parties are gotiyas and due to pending land dispute, an altercation took place between them. There is case and counter case. Both sides sustained injury. Petitioner claims clean antecedent.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.6599 of 2023(3) dt.23-06-2023 2/2 bail petition and submitted that the injury caused by this petitioner is found to be grievous in nature. It is further submitted that as per case diary, witnesses have supported the prosecution.

Considering the nature of injury and gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Kaushik/- U T
