JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. Petitioner was allegedly caught by the police after the alleged occurrence and looted articles are said to have been recovered from his conscious possession but submission on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner nor petitioner was caught just after the alleged occurrence and as a matter of fact, petitioner was picked up from his house one day after the alleged occurrence and thereafter, he was produced before the Judicial Magistrate, Bikramganj. To fortify the above-said contention, learned counsel for the petitioner submits that according to
Patna High Court Cr.Misc. No.32286 of 2015 (2) dt.17-08-2015 2/2 prosecution case itself, the seizure list was prepared on 2301-2015 at 10.45 p.m. but the petitioner was produced before the Judicial Magistrate-Ist Class, Bikramganj on 2501-2015 i.e. beyond the period of 24 hours. Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nasriganj P.S. Case No. 09 of 2015 to the satisfaction of Sri Basant Kumar, J.M. Ist Class-cum-Additional Munsif-2, Bikramganj at Rohtas. (Hemant Kumar Srivastava, J) A.K.V./- U T
