In this case, the petitioners are seeking anticipatory bail in connection with G.B. Nagar P.S. Case No.272 of 2019, registered for the offence punishable under Sections 30 (a), 33, 34, 36, 38, 41 (i) of Bihar Prohibition & Excise (Amendment) Act, 2016.

The police has recovered 153.900 liters of illicit liquor from the house of the petitioners, however, counsel for the petitioners submits that nothing has been recovered from their conscious possession and their name have come in the

Patna High Court CR. MISC. No.5450 of 2020(2) dt.02-03-2020 2/2 confession statement of co-accused.

Looking to the quantity of liquor recovered, this Court is not inclined to grant bail to the petitioners. Accordingly, their prayer for bail is rejected. However, if the petitioners surrender before the Court below within four weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
