The petitioner being the husband of the complainant is in custody in connection with Complaint Case No. 2249 of 2013 registered under section 498-A IPC.

It has been submitted that he is in custody since 11.03.2015. He is ready and willing to leave with the complainant as husband and wife cordially.

Counsel for the complainant, on the other hand, points out that the petitioner has married with another lady. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on

Patna High Court Cr.Misc. No.21037 of 2015 (2) dt.09-07-2015 2/2 furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction CJM, Katihar in Complaint Case No. 2249 of 2013 on condition that one of the bailors shall be own/close family member of the petitioner. After release from his custody the petitioner will continue to pay a sum of Rs. 750/- per month as a maintenance allowance until an appropriate order is passed in a proceeding to be filed by the complainant. The first instalment shall be effective from July, 2015. The amount can be paid to the complainant through the bank draft or by depositing the same in her bank account and/or depositing the amount in the Nazarat which the complainant shall be entitled to withdraw. In case of default in doing so continuously for two months the complainant shall have liberty to seek cancellation of his bail bonds by filing appropriate application.
