The petitioner seeks bail in a case under Section 392 and other sections of the Indian Penal Code and under section 27 of the Arms Act.
The informant lodged the case against unknown for snatching of his motor cycle, ornaments and cash. The petitioner is not named in the FIR. The petitioner was apprehended on mere suspicion on 10.09.2013. During the course of investigation some of the witnesses have stated that they saw the petitioner making firing but the petitioner was not put on T. I. parade. The witnesses who claimed to have seen the petitioner making firing did not come forward immediately after
Patna High Court Cr.Misc. No.33284 of 2015 (2) dt.19-08-2015 2/2 the occurrence and after much delay the stated before the police that they are eye witnesses of the occurrence. The petitioner is in jail since 10.09.2013 Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner has already remained in jail for last about two years, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahana, East Champaran, Motihari in Rajepur P.S.
