Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioners seeks bail in connection with Excise P.R. Case No. 359 of 2022 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 05.12.2022 and there is recovery of 360 liters of illicit liquor and the petitioner no. 1 is the driver of the vehicle and the petitioner no. 2 is labour and petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.6825 of 2023(2) dt.03-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts, period of custody and the recovery of liquor, this application for regular bail is allowed.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cum-Special Judge, Excise-II, Kaimur at Bhabua in connection with P.R. Case No. 359/2022.

The address of the petitioners shall be verified by the Court below before releasing the petitioners on Bail through the Superintendent of Police concerned and one of the bailor of both the petitioners shall be a close blood relative. (Sandeep Kumar, J) Shishir/- U T
