JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Islampur P.S. Case No. 74 of 2012, disclosing offences under Sections 420, 120(B), 406, 467, 468 and 471 of the Indian Penal Code.
Allegation as per F.I.R. is that earlier petitioner no.1 had filed a case against Krishna Prasad and Birendra Kumar for creating fraudulent sale-deed. Further, the complaint case was sent for registration and police after investigation found that she executed the sale-deed by by committing fraud in order to grab the land of her mother, though she has other three sisters also. Submission of learned counsel for the petitioners is that the the petitioners have falsely been implicated in this case and no case has been filed by the mother of petitioner no.1 and
Patna High Court Cr.Misc. No.7830 of 2019(2) dt.13-02-2019 2/2 also no civil suit has been filed. Further, they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda, in connection with Islampur P.S. Case No. 74 of 2012, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
