1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioners at the outset seeks permission to withdraw the anticipatory bail application with respect to petitioner no.2, namely, Raja Kumar @ Raj Kumar.
3. Permission is accorded.
4. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 352, 351(2), 3 (5) of BNS Act.
5. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that on 04.08.2024 Birendra in a drunken condition was abusing, on objection, he started assaulting and when his son came out, Birendra started firing, thereafter all accused persons

6. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that though it is alleged that Birendra started firing but then no one was injured. It is also submitted that no specific allegation is alleged against the petitioner.
7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
8. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Khusrupur P.S. Case No.353/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
