JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 This is an application for grant of anticipatory bail in connection with Barauli P.S. Case No. 314 of 2018, disclosing offences under Sections 279 and 304 of the Indian Penal Code. Allegation against the petitioner is of intentionally dashing the son of the informant by motorcycle causing injury to him and thereafter the injured was brought to Gopalganj Sadar Hospital from where he was referred to Gorakhpur, further from Gorakhpur to Lucknow and thereafter from Lucknow to P.M.C.H., Patna for better treatment, where he died. Submission of learned counsel for the petitioner is that the accident is not intentional rather it is incidental and the petitioner was carrying a genuine Driving License at the time of incident and he is ready to abide by any condition imposed upon him.

Having heard both sides, considering the above facts and circumstances of the case, this application is disposed of with a direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of receipt of the order along with the Driving License and the learned court below after verifying the Driving License of the petitioner, shall release him on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Barauli P.S. Case No. 314 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is further subject to the condition that the petitioner will not leave this country without the permission of learned court below.
