The petitioner seeks bail in a case registered for the offences punishable under sections 376, 511 and other allied sections of the Indian Penal Code and section 3(x)(xi) of the S.C./S.T. (Prevention of Atrocities) Act.

The prosecutrix made allegation that while she was going to the school, the petitioner took her in a lonely orchard and tried to commit rape but the petitioner could not succeed. The petitioner is alleged to have assaulted the prosecutrix. It is submitted that the petitioner filed a complaint petition against the informant who is a teacher in a school about her non-presence in the school. The petitioner is in

Patna High Court Cr.Misc. No.31447 of 2015 (2) dt.17-08-2015 custody since 02.04.2015.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for about four and a half months and he has got no criminal antecedent, let the petitioner above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. N. Roy, Judicial Magistrate, 1st Class, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case no. 190 of 2014.
