The petitioner seeks bail in connection with Imamganj P.S. Case No.149 of 2019 registered under Sections 302/34 of the Indian Penal Code.

The accusation is that in the morning of 26.08.2019, the informant Panwa Devi received information from her neighbouring village about the lying of dead body of her son Vikas Kumar in village-Bhat Bigha. Thereafter, the informant rushed there and found the dead body of her son Vikas Kumar. The informant claimed that since before ten days, Lal Bahadur Rai (petitioner), Dinesh Rai, Kamlesh Rai, Satish Rai and Yamraj Rai were giving threatening to her and her son to kill on the suspicion that her son Vikas Kumar has kidnapped the wife

Submission is that on mere suspicion, the petitioner and his other associates have falsely been implicated in this case. While on investigation, the police has already submitted the chargesheet but no tangible material has been collected by the Investigating Officer showing the participation of the petitioner in the alleged crime. The petitioner has no criminal antecedent and is in custody since 27.08.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Shergaati, in connection with Imamganj P.S.
