JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Ghoshi (Okari) P.S. Case No. 102 of 2015 registered for the offences punishable under Sections 353, 401 of the Indian Penal Code and Section 25(1-b)a/26/35/37 of the Arms Act.

Allegedly two country made pistols and eleven live cartridges of .315 bore, kept beneath the seat of the vehicle, were recovered in which the petitioner with eight other persons were found sitting. Similarly situated other co-accused, namely, Rahul Kumar @ Dharamveer Kumar, Netrapal Singh and Pramod Kumar have already been allowed bail by another co-ordinate Bench of this Court and the petitioner having no criminal antecedent, suffering in custody since 10.05.2015, deserves sympathetic

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned S.D.J.M., Jehanabad arising out of Ghosi (Okari) P.S. Case No. 102 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
