JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 This is an application for grant of anticipatory bail in connection with Aurangabad Mahila P.S. Case No. 32 of 2018, disclosing offences under Sections 498A, 323, 307, 120B of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Allegation against the petitioners is of subjecting to his wife-informant with respect to demand of Rs.12,00,000/- and for that, assaulted her and ousted her from the house. Submission of learned counsel for the petitioner no.1 is that the whole allegation is false and concocted. Though they

On the other hand, learned counsel for the opposite party no.2 has submitted that she is interested in residing with the petitioners and further submitted that her husband is working in SAIL and getting handsome salary.
Having heard both sides, in view of the facts and circumstances, as stated above, this application is disposed of with a direction that let the petitioner no.1, above named, surrender before the learned court below on 07.08.2019 and on condition that petitioner no.1 has to pay Rs. 8000/- per month to the opposite party no.2-wife for a period of one year, the provisional bail granted to the petitioner no.1, vide order dated 11.02.2019, shall be confirmed.
It is expected that during that period, the opposite party no.2-wife is at liberty to approach the Family Court for grant of maintenance to her, for which, the petitioner shall cooperate in disposal of the same. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
