JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Petitioner being elder brother of the late husband of the informant is languishing in custody since 12.02.2016 in a case registered for the offences punishable under Sections 341, 323, 498A, 354(B), 379, 352, 504/34 of the Indian Penal Code.

The prosecution case is that after the death of the husband of the informant the in-laws including the petitioner used to torture and assault.

It is submitted by learned counsel for the petitioner that due to the torture inflicted by the informant her husband consumed poison leading to registration of Suryagarha P.S. Case No. 15 of 2015 by the brother of the petitioner wherein the informant is an accused, hence, as a retaliatory measure the present case has been lodged. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.23674 of 2016 (2) dt.26-05-2016 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Suryagarha (Manikpur) P.S. Case No. 257 of 2015.
