Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A)/34 IPC.

The statement of the victim girl recorded under Section 164 Cr.P.C. would show that she was a minor and induced by the petitioner and others to go with the petitioner. Learned counsel for the petitioner has relied on the school document of the girl for his contention that she was in fact a major as her date of birth was 25.01.2001. Considering nature of allegation against the petitioner,

Patna High Court CR. MISC. No.16751 of 2021(2) dt.23-11-2021 2/2 this is not a fit case for grant of anticipatory bail to the petitioner in connection with Piprahi P.S.Case No.218 of 2019 pending in the court of learned Judicial Magistrate 1st Class, Sheohar. Hence, prayer is refused.

Petitioner is directed to surrender and pray for regular bail within two weeks.
