1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under section 120(B) of the Indian Penal Code and Sections 25(1-b)A, 26 and 35 of the Arms Act.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case by the informant with an allegation that from his possession cartridge and one country made pistol were recovered. It is further submitted that the petitioner is in custody since 07.08.2023 and has antecedent of 8 cases. It is next submitted that the charges have been framed but then the trial has not commenced. It is further submitted that the petitioner will not abscond rather will co-operate in the trial.

4. The learned APP opposes the prayer for regular bail application of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Laukaha P.S. Case No.215/2023, G.R. No.1434/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. Further, one of the bailor of the petitioner shall be his father Ramdev Sah.

7. However, the learned trial court before accepting the bail bonds of the petitioner shall verify the criminal antecedent of the petitioner and in the event if it is found that the petitioner has antecedent of more than 8 cases in that event, the present order shall not be given effect to but if the petitioner has antecedent of 8 cases excluding the present case the bail bonds of the petitioner shall be accepted forthwith.
