JUSTICE ARVIND SRIVASTAVA ORAL ORDER 24-06-2020 Learned counsel for the petitioners seeks permission to make necessary correction in the array of the parties as the name of father of petitioner No.2 has wrongly been typed. In view of the above, let the necessary correction, as submitted, be carried out within a period of four weeks of regular Court.

Heard learned counsel for the petitioners and learned counsel for the State.

Patna High Court CR. MISC. No.4170 of 2020(2) dt.24-06-2020 2/2 The petitioners apprehend their arrest in connection with Tankuppa P.S. Case No. 90 of 2019 registered for the offence under Sections 147, 148, 149, 341, 323, 325, 326, 324, 307, 504, 506, 34 and 120(B) of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, there is general and omnibus allegation against the petitioners and no specific overt act is attributed to them. The petitioners are said to have been member of mob only and except that no cogent material is available on record against the petitioners. Hence, the petitioners deserve the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioners, above named, in the even of their arrest or surrender within a period of four weeks from today, be released on anticipatory bail on furnishing their personal bond to the satisfaction of learned Additional Chief Judicial Magistrate-I, Gaya in connection with Tankuppa P.S. Case No. 90 of 2019 subject to the conditions laid down under Section 438(2) of the Cr. P.C.
