Petitioner retired from the post of Junior Engineer on 31.12.2016 from the office of respondent no. 5, the Executive Engineer, Minor Irrigation Division, Saharsa. He had prayed for payment of his pension and other retiral dues, which have not been paid.

A supplementary affidavit has been filed by the petitioner stating therein that all dues have been paid to him except the monetary benefit of ACP and MACP.

A counter affidavit has been filed on behalf of respondents 3 to 5 stating therein that retiral dues of the petitioner has been paid, but, no averment is there with regard to

Considering the nature of claim, made by the petitioner in the supplementary affidavit, let the petitioner file a representation regarding his remaining dues before the respondent no. 5, the Executive Engineer, Minor Irrigation Division, Saharsa, which will be disposed of within a period of four months from the date of filing of such representation. Any amount due to the petitioner, along with admissible interest, would be paid to the petitioner within one month thereafter. If certain dues are inadmissible, the same shall be communicated to the petitioner by speaking order sent through registered post. The writ application, accordingly, stands disposed of.
