2. In the present case, the petitioner seeks bail in connection with Darbhanga Town P.S. Case No. 09 of 2018, registered for the offences under Sections 401, 413 and 414 of the Indian Penal Code.

3. As per the prosecution case, police has been conducting investigation in Darbhanga Town PS Case No. 230/2017 registered under Section 461/379 of the IPC. During investigation, the co-accused Sanjay Choudhary was apprehended who named this petitioner and other co-accused persons with whom he used to commit theft.

4. Learned counsel appearing on behalf of the

No.6552 of 2026(2) dt.04-02-2026 2/3 petitioner submits that petitioner has been falsely implicated in this case and nothing incriminating has been recovered from his person or possession. The petitioner has been made accused only on the basis of confessional statement of Sanjay Choudhary and apart from that there is no material to show the complicity of the petitioner in the whole occurrence. The petitioner has not been even put to any Test Identification Parade by the police. There is no recovery of any stolen property from this petitioner and no victim of any property stolen by this petitioner has come forward to lodge any case. The petitioner is having antecedent of four cases and he is on bail in all these cases. The petitioner is in custody since 10.09.2025 and charge sheet has been submitted.

5. Learned APP appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the vague nature of allegation, submission of charge sheet and period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned CJM I/C, Darbhanga/concerned

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
