In this case, the petitioner is seeking bail in connection with Murliganj P.S. Case No. 54 of 2013 registered for offences under sections 147, 148, 323, 447, 427, 384, 504, 120 'B' of the Indian Penal Code and section 27 of the Arms Act. The petitioner and other accused persons went to the land of the victim-informant and started making construction of thatch house. When the informant and his brother could know, they reached there whereupon the accused persons surrounded them and assaulted badly.

Allegation has been made that the accused persons resorted to firing five-six round, but the informant and his brother could save their life.

Patna High Court Cr.Misc. No.23523 of 2016 (2) dt.30-05-2016 2/2 The counsel for the petitioner submits that there is no direct allegation against the petitioner, save and except, the omnibus allegation and other co-accused, namely, Vishan Rishideo @ Vishwanath Rishideo has already been granted bail by this Court in Cr. Misc. No. 32965 of 2015.

Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 54 of 2013.
