In this case, the petitioner is seeking bail in connection with Gogri P.S. Case No. 268 of 2015 registered for offence under section 304/34 of the Indian Penal Code.

Allegation has been made that the son of the informant was facing loose motion, approached the shop of the petitioner, namely, Apna Barik Dawakhana Gogri, he had given injection of some drug which led to the death of the victim. The counsel for the petitioner submits that the petitioner is running a shop of medicine with a proper license and had injected the medicine for the benefit of the victim. It appears that without going for a sensitive test, the drug has been injected to the body of victim which led to his death.

Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on or after 21st June 2016 on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, Judicial Magistrate-I, Khagaria in connection with Gogri P.S.
