The petitioner is apprehending his arrest in connection with Tisiauta P.S. Case No. 43 of 2010 registered for offences punishable under Sections 323. 377, 511, 379/34 of the Indian Penal Code.

Allegation against the petitioner is of attempt to commit unnatural offence and also some other offence. It appears that the case is of the year 2010 and the petitioner has now come up before this Court for grant of anticipatory bail after 7 years of the alleged occurrence.

Submission of the learned counsel for the petitioner is that both the parties have settled the dispute and he has been falsely implicated in this case.

Patna High Court Cr.Misc. No.36512 of 2017 (2) dt.10-08-2017 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, petitioner may surrender before the Court below within a period of six weeks and make prayer for regular bail, which will be disposed of by the Court below on its own merit without being prejudiced by the order of this Court.

With the aforesaid observation, the application stands disposed of.
