2. The petitioner apprehends his arrest in connection with Sakra P.S. Case No. 38 of 2023, registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code and Section 4 of the POCSO Act.

As per allegation, the daughter of the informant went for coaching but she did not return till 11 am. Thereafter, the informant got information from villagers that Rambabu Pandit (petitioner) and Raman Kumar used to talk with the victim and have kidnapped her.

3. Learned counsel for the petitioner has submitted that the victim did not name the petitioner in her statement

Patna High Court CR. MISC. No.8763 of 2024(2) dt.20-02-2024 2/2 under Section 164 of the CrPC. She went with co-accused Rahul Sharma with her own sweet will. He has further submitted that on similar footing co-accused Raman Kumar has been granted bail.

4. The learned court below shall verify the submission made by the learned counsel for the petitioner and if the submission is found to be true, the petitioner shall be granted anticipatory bail.

5. With these observations, the anticipatory bail petition is disposed of.
