The petitioner Shamim Mian seeks bail in Narkatiaganj G.R.P.S. Case No. 02 of 2014, registered for the offences punishable under Section 302 and Section 27 of the Arms Act.

The Chowkidar Vinod Kumar Singh @ Shambhu Singh alleged that when he was on railway crossing he heard a sound of firing. One person was apprehended who disclosed his name as Sheo Kumar Sah who alleged to have disclosed that the petitioner had fired.

Learned counsel for the petitioner submits that there is no eye witness of the occurrence and on the basis of confession of Sheo Kumar Sah name of the petitioner figured in the case.

Patna High Court Cr.Misc. No.34539 of 2014 (4) dt.15-01-2015 Considering the facts aforesaid, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Bettiah, West Champaran in connection with Narkatiaganj P.S. Case No. 02 of 2014.
