The petitioner is languishing in custody since 11.10.2018 in a case registered for the offences punishable under 25(1-B) a, 26 and 35 of the Arms Act.

The prosecution case is that from the posession of the petitioner, one country made loaded pistol, three cartridges, Rupees Forty Five Thousand cash and mobile phones were recovered.

It is submitted by learned counsel for the petitioner that the petitioner is not having any criminal antecedent and the investigation has already been concluded. Though statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent but after institution of the present case, the petitioner has been remanded in two other

Patna High Court Cr.Misc. No.9555 of 2019(2) dt.18-02-2019 2/2 cases being Khodawanpur P.S. Case No. 214 of 2018 and Khodawanpur P.S. Case No. 220 of 2018. Statement to that effect has been made in the supplementary affidavit dated 13.2.2019. However, both the cases have been registered against unknown.

Learned APP submits that recovery of arms has been made from the petitioner.

Considering the fact that the investigation has already been concluded and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Begusarai in connection with Garhpura P.S.
