1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Baikunthpur P.S. Case no.358 of 2022 registered under sections 20, 22, 24, 25 and 29 of the N.D.P.S. Act.

3. As per the prosecution case, 2 kgs of ganja was recovered and Abhishek Kumar and Rohit Kumar were caught at the place of occurrence. It is further stated that the apprehended accused disclosed that they were going to supply ganja to the petitioner.

4. Learned counsel for the petitioner submits that from the F.I.R. itself, neither any incriminating article was recovered from the possession of the petitioner nor does the

Patna High Court CR. MISC. No.7507 of 2024(2) dt.20-02-2024 2/2 petitioner has any concern with the other co-accused. The petitioner is in custody since 13.11.2023 and chargesheet has been submitted in the case. He has no criminal antecedent.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R. against the petitioner, no incriminating article having been recovered from his possession, his being in custody since 13.11.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Baikunthpur P.S. Case no.358 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Gopalganj.
