JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Jalley P.S.Case No. 35/2016, disclosing offences under sections 341, 323, 324, 307, 332, 504, 506, 427. 379/34 of the Indian Penal Code.

The informant is a Conductor in a private bus. It is alleged that the staff of the private bus including the petitioner compelled a bus, run by the Bihar Road Transport Corporation, to stop and thereafter they damaged the said bus and abused and assaulted the staff of the said bus. Allegedly, they indulged in such act as plying of buses by the Corporation adversely affects the business of private players.

Learned counsel for the petitioner has submitted that the

Patna High Court Cr.Misc. No.22956 of 2016 (2) dt.24-05-2016 petitioner has no criminal antecedent and there is no specific allegation of assault against him. It has further been submitted that no offence under section 307 of the I.P.C. is said to be made out on the basis of allegation made in the F.I.R. Considering the above, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in Jalley P.S.Case No. 35/2016. This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
