The petitioner seeks bail in connection with Mansi P.S. Case No. 219 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 11.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 267 litres of liquor from a pickup van.

Learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the pickup van

Patna High Court CR. MISC. No.5966 of 2022(2) dt.08-03-2022 2/2 rather had taken lift, further co-accused Rohit Kumar has been granted bail vide order dated 22.12.2021 in Cr. Misc. No. 69181 of 2021.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and co-accused has been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Khagaria in connection with Mansi P.S. Case No. 219 of 2021.
