Petitioners apprehend arrest in a case registered for the offences punishable under Sections 471, 472, 473, 467, 468, 420, 120B of the Indian Penal Code and Section 30(a), 32(c), 31 of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, 739.245 liters foreign liquor has been recovered from the truck standing near the main road. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. Petitioners have been made accused in the present case only on the basis of
Patna High Court CR. MISC. No.6268 of 2023(2) dt.13-04-2023 2/2 confessional statement of co-accused Mahavir Lohara. No incriminating material has been recovered from the conscious possession of the petitioners. Petitioners have got no criminal antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Exclusive Special Excise, Judge 2nd, Bhojpur at Ara in Sandesh P.S.
