The petitioner is apprehending his arrest in connection with Chapra Muffasil P.S.Case no.233 of 2018 dated 11.6.2018 , registered for offences punishable under Sections 384, 386/34 of the Indian Penal Code.
Prosecution case as per the FIR is that there is land dispute for ancestral land, which came in his possession after the partition and the accused persons tried to grab the land and demanded Rangdari from him.
Submission of the learned counsel for the petitioner is that there is land dispute between the parties and the proceeding under Section 144 of the Cr.P.C. was also earlier initiated between them and one of the co-accused Vikarma
Patna High Court CR. MISC. No.12695 of 2019(3) dt.30-04-2019 2/2 Manjhi against whom there is also similar allegation has been granted privilege of anticipatory bail, vide order dated 9.10.2019 passed in Cr. Misc. No.59473 of 2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Chapra Muffasil P.S.Case no.233 of 2018 dated 11.6.2018, subject to condition as laid down under Section 438
(2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
