JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Sheikhpura P. S. Case No. 336 of 2009 registered under Sections 147, 148, 149, 341, 342, 323, 337, 504, 307 and 353 of the Indian Penal Code.

It is contended by learned counsel for the petitioner that there is no truth behind the allegation made in the FIR. Though the FIR was instituted on the basis of the selfstatement of ASI of Kusumbha O. P., four out of eleven persons named in the FIR were not sent up for trial. The other two coaccused, namely, Pramod Bind and Majo Bind having more or less identical allegation to that of the petitioner have already

Patna High Court Cr.Misc. No.21796 of 2016 (2) dt.20-05-2016 2/2 been granted bail by a co-ordinate Bench of this Court vide order dated 13.05.2010 passed in Cr. Misc. No. 12919 of 2010. It is further contended that the petitioner, being a poor labourer, was totally unaware about the pendency of the present case and when he came to know about the pendency of the case against him, he voluntarily surrendered before the court below. Regard being had to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in Sheikhpura P. S. Case No. 336 of 2009 .
