====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 12-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 351(2), 352 and 3(5) of the BNS Act, 2023.
3. The prosecution story in brief is that the informant namely Sahdeo Sharma alleged that on 11.10.2024 at around 05:00 PM, while he and his son were sitting outside their house,
Patna High Court CR. MISC. No.6248 of 2025(3) dt.12-05-2025 2/3 in the meantime, all FIR named accused persons arrived and objected to them for creating a ruckus. It is further alleged that upon his reply, all accused persons armed with axes, iron rods and sharp weapons, attacked him and his family members, causing head injuries. It is next alleged that the accused persons also entered his house, verbally abused and molested Asha Devi and Pinky Devi and snatched gold jewellery from Asha Devi.
4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in the present case. It is next submitted that petitioners are persons with clean antecedent. Learned counsel for the petitioners further submits that the allegations are general and omnibus in nature and nothing specific has been attributed against them. It is also submitted that petitioners and informant are next door neighbours and there are disputes between them relating to drainage and pathway due to which the petitioners came to be falsely implicated in the present case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the fact that the allegation against the petitioners is that of assault, abuse and theft and from the perusal of the Injury Report it transpires that altogether three

No.6248 of 2025(3) dt.12-05-2025 3/3 persons were injured in this case and out of them injury of two persons are simple in nature and the third one has grievous injury but the injury is not on the vital part of the body and also the fact that all the petitioners are persons with clean antecedent. Under these circumstances, the Court is inclined to grant the privilege of anticipatory bail to the petitioners.
7. Accordingly, the petitioners in the event of their arrest or surrender within four weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bonds of Rs.25,000/-(Rupees Twenty-Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Nawada in connection with Pakaribarawan P.S. Case No. 458 of 2024, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
