2. The petitioner is in custody since 09.02.2016 in connection with Sahkund (Sajour) P.S. Case No. 35 of 2015 for the offences alleged under Sections 147, 148, 149, 151, 182, 109, 186, 283, 342, 337, 328, 323, 307, 353, 332, 333, 379, 427, 504 and 506 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated as in fact he was not present at the place of occurrence. The petitioner is not named in the first information report which has been instituted against 28 named accused persons. The petitioner's case stands on far better footing than co-accused Deepak Sah @ Budhwa @ Budhua who is a named accused in the FIR has been granted bail by a coordinate Bench of this Court in

Patna High Court Cr.Misc. No.22172 of 2016 (2) dt.20-05-2016 2/2 Cr. Misc. No. 10533 of 2016.

4. In the aforesaid facts let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Sahkund (Sajour) P.S. case No. 35 of 2015.
