====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 Petitioners seek regular bail in connection with Nautan P.S. Case No. 272 of 2019 registered for the offence punishable under Sections 413, 414, 420, 467, 469, 471/34 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of Arms Act. Allegation as per prosecution case, petitioners were arrested alongwith co-accused person with stolen motorcycle and there is a recovery of one loaded country made pistol from the possession of petitioner no.1 and one live cartridge was also recovered from petitioner no.2.
Submission of the learned counsel for the petitioners is that nothing has been recovered from the conscious possession of the petitioners and petitioners have falsely been
Patna High Court CR. MISC. No.7402 of 2020(2) dt.25-02-2020 2/2 implicated in this case and they are in custody for more than seven months. Petitioners have got no criminal antecedent and they are in custody since 10.07.2019 and the charge sheet has already been submitted.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bettiah, West Champaran in connection with Nautan P.S. Case No. 272 of 2019.
