Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 302 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is alleged to have fired along with another co-accused at the deceased and the Doctor has found firearm injury on the person of the deceased. The Doctor was of opinion that caused of death was head injury which is alleged against other co-accused. Petitioner is in custody since 19.07.2018. It appears that in the true typed copy of the FIR material fact is suppressed that the petitioner had caused firearm injury to the deceased.

Considering the entire facts, I am not inclined to enlarge the petitioner on bail in connection with Chewara Police

Patna High Court CR. MISC. No.7583 of 2019(3) dt.24-04-2019 2/2 Station Case No. 06 of 2018 pending in the court of learned Sub-Divisional Judicial Magistrate, Sheikhpura. Hence, prayer for bail is refused.
