The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE AMARESH KUMAR LAL ORAL ORDER 20-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code.

The allegation against the petitioner is that he entered into the cash room of the petrol pump, took the money and started fleeing away from there. On raising alarm by a staff of the petrol pump, the petitioner was chased. The police was also informed. On chase, the petitioner was apprehended and the theft money of Rs.12,000/- was recovered from the possession of the petitioner.

It is submitted by the learned counsel for the petitioner that petitioner has been apprehended on mere suspicion. He has no criminal antecedent. He has been in custody since 9.3.2015. Chargesheet has already been submitted and there is no chance of tampering with the witnesses.

No.32492 of 2015 (2) dt.20-08-2015 2 / 2 Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Banka/court concerned in Belhar P.S. Case No.36 of 2015 corresponding to G.R. no. 452 of 2015 after framing of charge with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence on two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
