The petitioners seek bail in a case registered under Sections 376/34 of the Indian Penal Code.

Allegation is that the accused persons after breaking the door of the complainant's house entered into and committee rape upon her.

It has been submitted on behalf of the petitioners that the petitioner No.1 is in custody since 25.10.2018 and petitioner No.2 is in custody since 11.10.2018 and have got no criminal antecedent. There is no allegation of tampering of witnesses

Patna High Court CR. MISC. No.5788 of 2019(3) dt.18-04-2019 2/2 alleged against the petitioners. Petitioners have falsely been implicated in the present case. Other co-accused have been granted bail vide Annexure 3 and 3/1 to the present application. On behalf of the State, it is submitted that the petitioners are named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- cum-Sub Judge 12th, Muzaffarpur in connection with Complaint case No.2158 of 2011 (Tr. No.965 of 2018).
