The petitioner being the mother of the husband of the victim is languishing in custody since 10.07.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The accusation is of killing the sister the informant after six years of the marriage for non-fulfillment of the dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner is 85 years of age and there is no specific accusation against the petitioner. Moreover, other similarly situated accused Pillu @ Ashrarul Haque has been
Patna High Court Cr.Misc. No.33536 of 2014 (03) dt.12-01-2015 2/2 granted bail vide Cr. Misc. No. 1335 of 2014. It is submitted by learned counsel for the informant that the petitioner and Pillu were in the house when victim died and post-mortem suggests several injuries. Considering the advance age of the petitioner and the fact that similarly situated accused has been granted bail, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Barsoi (Sudhani O.P.) P.S. Case No. 88 of 2013.
