The petitioner is languishing in custody since 23.06.2018 in a case registered for the offence punishable under Section

379. of the IPC.

The prosecution case is to the effect that on 09.05.2018, at 1.05 P.M., the informant p arked his motorcycle and went in the shop and at 1.30 P.M., when he came out, he found his motorcycle missing, leading to registration of the FIR against unknown persons. Subsequently, The petitioner was apprehended in connection with Samastipur Town P.S. Case No. 142 of 2018, where from the possession of the petitioner, stolen motorcycle of the informant was recovered and in that case, the

Patna High Court Cr.Misc. No.5484 of 2019(2) dt.31-01-2019 2/3 petitioner confessed his guilt about committing theft of the informant's motorcycle.

It is submitted by learned counsel for the petitioner that four other persons were made accused in Samastipur Town P.S. Case No. 142 of 2018, but they have been granted bail. It is further submitted that though, the petitioner has been made accused in nine other cases by the police maliciously, but in most of the cases, he is on bail. It is further submitted that the petitioner has not been put on T.I. Parade and the investigation has already been concluded.

Learned APP submits that the recovery has been made from the petitioner.

Considering the nature of accusation and the fact that the petitioner has not been put on T.I. Parade, investigation has already been concluded and period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned CJM, Samastipur in connection with Samastipur Town P.S. Case No. 130 of 2018. Learned Court below would be at liberty to cancel the bail bonds of the petitioner if he fails to appear before the learned Court below on three consecutive occasions or if he gets
