The petitioner seeks pre-arrest bail in connection with Bathnaha P.S. Case No.161 of 2018 registered for the offence punishable under Sections 341, 323, 324, 307, 379, 504 and 506 read with 34 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that there is a case and counter case and other coaccused namely, Lal Dhari Sah, Mukesh Sah and Lal Bihari Sah have already been granted pre-arrest bail by a Bench of this Court vide order dated 17.12.2018 passed in Cr. Misc. No.71021 of 2018.
Considering the submission made above, in the event of arrest or surrender in the court below, the petitioner, who is
Patna High Court Cr.Misc. No.3555 of 2019(2) dt.25-01-2019 2/2 said to be a man of clean antecedent, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No.161 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
