JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-04-2023 At the outset, learned counsel for the State submits that after introduction of the Criminal Law (Amendment) Act, 2018, there is bar to file anticipatory bail petition under section 438 (4) of Cr.P.C. in an FIR registered under section 376(3) of Indian Penal Code, 1860.

However, learned counsel for the petitioner seeks permission to withdraw this pre-arrest bail petition. Permission is accorded and this Cr.Misc.petition is dismissed as withdrawn.
