The petitioner seeks regular bail in connection with Dariyapur PS case no. 412 of 2018 registered for the offence punishable under Sections 25(1-b)a, 26, 35 of Arms Act. The allegation is regarding the police having received information that miscreants were waiting for arrival of a consignment of illicit liquor and when the police had reached the said place, certain miscreants started running away, however some of them were caught and illicit country made pistol and cartridge etc. were recovered.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case
Patna High Court Cr.Misc. No.5671 of 2019(2) dt.01-02-2019 2/2 although no recovery has been made from the person of the petitioner. The petitioner is said to be having clean antecedent and is languishing in custody since 17.12.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Saran at Chapra in connection with Dariyapur PS case no. 412 of 2018. (Mohit Kumar Shah, J) rinkee/- U T
