JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 28-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Both the parties belonging to the member of Outfit Organisation People Liberation Front confronted themselves whereupon an allegation has been attributed by the informant that petitioner including others had kidnapped the victim Awdhesh Paswan as well as Bhagwan Das.

It is evident that presence of victim were perceived through the witnesses, even then the I.O. had not cared to examine them.

At an earlier occasion prayer for bail of the petitioner was rejected vide order dated 30.01.2016 under Cr.Misc.No.53735 of 2015 in the background of fact that this occurrence being that of

Patna High Court Cr.Misc. No.25255 of 2016 (02) dt.28-06-2016 year 2002 found absence of petitioner who lastly surrendered on 27.05.2015 and so, while rejecting the prayer opportunity was given to the petitioner to renew his prayer after framing of charge. It is apparent from the order sheet that the charge has already been framed against the petitioner and one Bindeshwari Yadav on 25.04.2016.

Consequent thereupon petitioner Ramjee Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IInd, Danapur, in S.Tr. No.136 (A) of 2003 arising out of Paliganj P.S.Case No.111 of 2002.
