The petitioner seeks bail in a case under Section 420 of the Indian Penal Code and under section 66 of I. T. Act. From the account of informant some money was withdrawn and it was found that two tickets in the name of Laxmi Narayan Das and Sudha Rani Das were booked for which money was withdrawn from the account of informant. On enquiry, Laxmi Narayan Das disclosed that he entrusted the work of booking tickets to the petitioner, Ritu Raj Kumar. The petitioner requested Nitish Kumar who, in turn, entrusted the work to Gyan Prakash Bharti. The money was withdrawn on the I. D. of Gyan Prakash Bharti. Patna High Court Cr.Misc. No.33006 of 2015 (2) dt.19-08-2015 2/2 statement of Laxmi Narayan Das.
Considering the facts aforesaid and the fact that the petitioner neither booked the tickets nor withdrew the amount, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajiv Kumar Bharti, learned Judicial Magistrate, 1st class, Patna in Budha Colony P.S. Case No. 122/2015.
