JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-02-2020 The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 894 of 2019, registered for offences punishable under Sections 399, 401, 402, 413, 414, 120(B) of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Petitioner was arrested while preparing for dacoity and there is recovery of one country made pistol and cartridge. Apart from that petitioner is accused in five other cases. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has been in custody for four months.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation as

Patna High Court CR. MISC. No.6992 of 2020(2) dt.06-02-2020 2/2 well as criminal antecedent of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the charge is framed, petitioner will be at liberty to renew his prayer for bail.

This application is accordingly dismissed.
