JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 The petitioner is languishing in custody since 20-9-2013 in a case registered under sections 376(G)/365 of the Indian Penal Code.

The accusation is of making forceful physical relationship with the informant by the petitioner and three others. Considering the inconsistency between the first

Patna High Court Cr.Misc. No.33137 of 2014 (3) dt.09-01-2015 2 / 2 information report and the subsequent statement of the informant and accusation of rape not being supported by the medical opinion, accused Rakesh Kumar Jha has been granted bail in Cr. Misc. No. 8679 of 2014.

Statement has been made in paragraph no.3 of the petition that the petitioner has got no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Ad-hoc Additional Sessions Judge-II, Supaul in Sessions Trial No. 239/13 arising out of Kishanpur P.S. Case No. 168/2013 dated 20-9-2013. The learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions and gets substantially involved in some serious nature of offence.
