This application, for grant of anticipatory bail, arises out Agamkuan Police Station Case No. 380 of 2018, disclosing offences under Sections 419, 420, 467, 468, 471, 379 and 34 of the Indian Penal Code.

Two persons, namely, Dhananjay Kumar and Murari Kumar Pandey, were arrested by the police. Allegedly, in a Scorpio vehicle, 5-6 persons were sitting and on seeing the police, they attempted to flee away. Above two persons were arrested and from them, few ATM cards, cash and mobile phones were recovered. They are said to have disclosed to the police that they duped innocent people by asking them to deposit security money in their account in name of lottery and misappropriated the amount so received.

Learned Counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.6092 of 2019(2) dt.04-02-2019 2/2 he has been implicated on the disclosure made by the said two persons and also because he is the owner of the said vehicle. He has submitted that the said two persons, namely, Dhananjay Kumar and Murari Kumar Pandey, have been granted regular bail by the Court below.

Considering the above submission, this application is allowed.

Let the petitioner, Manoj Kumar, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, in connection with Agamkuan Police Station Case No. 380 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
