The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 427, 323, 307, 384, 379, 504, 506/34 of the Indian Penal Code. The prosecution case in nutshell is that when the informant was sitting at his door, in the meantime, petitioner along with other co-accused persons, variously armed, came at the door of informant and started
Patna High Court CR. MISC. No.6124 of 2023(2) dt.10-04-2023 2/3 demanding ransom. When the informant denied for paying ransom money, he was assaulted. It is further alleged that petitioner assaulted the informant by means of iron rod due to which he sustained head injuries. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. There is case and counter case between the parties and both parties have sustained injuries as alleged in separate occurrence. It is further submitted that injury sustained by the informant is simple in nature. Moreover, the petitioner is languishing in judicial custody since 21.10.2022.
Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for Bail.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody,
Patna High Court CR. MISC. No.6124 of 2023(2) dt.10-04-2023 3/3 this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Begusarai Muffasil P.S. Case No. 306 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
