Petitioner and one co-accused, namely, Sipi @ Rohit Kumar Singh were caught just after the alleged occurrence and the informant, specifically, stated in his written report that it was co-accused Sipi @ Rohit Kumar Singh who opened fire on the deceased. Moreover, confessional statement of co-accused Sipi @ Rohit Kumar Singh was recorded and in the said confessional statement, aforesaid co-accused Sipi @ Rohit Kumar Singh confessed this fact that an altercation had taken place at the wine shop and it was he who took out pistol and shot fire on the deceased. The aforesaid coaccused also admitted in his confessional statement that the petitioner happens to be disabled person.

Taking note of the aforesaid facts and circumstances as well

Patna High Court Cr.Misc. No.35279 of 2015 (2) dt.26-08-2015 as submissions of the parties and also keeping in mind that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in K. Hat (Maranga) P.S. Case no. 160/2015.
